SALES CONDITIONS

Article 1 – Scope and Purpose

1.1 Scope

These General Terms and Conditions of Sale and Use (hereinafter referred to as “GTC”) apply to any connection and navigation on the website operated at the following address: https://belull.com/ (hereinafter the “Site www.belull.com” or the “Site”).

This Site is owned by its publisher, the company Epsilon Composite, a simplified joint-stock company with a capital of €3,319,960, registered in the Bordeaux Trade and Companies Register under number 342 320 272, with its registered office located at 5 route de Hourtin – 33340 Gaillan Médoc (hereinafter “Epsilon Composite” or the “Company”).

The GTC apply without restriction or reservation to all sales concluded between the Company and any individual wishing to make a purchase on the Site (hereinafter the “Customer”).

By these terms, the Customer formally declares that they are a private individual, not acting as a professional, of legal age or emancipated, and have full legal capacity to contract and place an order online.

The Customer and Epsilon Composite agree that their relationship is governed exclusively by these GTC. In this regard, the Customer acknowledges that validating an order with a first click on a “I agree” checkbox followed by a validation click constitutes irrevocable acceptance of these GTC. This validation, combined with the authentication and non-repudiation procedure and the protection of message integrity, constitutes unequivocal consent from both Parties, thereby finalizing the remote sales agreement.

Epsilon Composite reserves the right to adapt or modify these GTC at any time. Each order is deemed to be placed under the GTC in force on the date of its submission on the Site, with the online publication date serving as the effective date.

Purpose

These GTC are intended to define the framework for online sales of decoration and furniture products and the resulting rights and obligations.

The GTC govern:

  • The organization of the legal relationship between Epsilon Composite and the Customer.
  • The terms of sale between Epsilon Composite and the Customer (price, order, payment, delivery, etc.).

Article 2 – Presentation of Products

The characteristics of the products offered for online sale are presented in the various sections of our Site.

Certain products are available as custom-made items and cannot be purchased online. The Customer will be redirected to a contact and inquiry form. Only the information exchanged with the sales department will be binding for the order. Technical and commercial information provided on the Site is for informational purposes only.

The photographs displayed on the Site are not contractual.

Discrepancies between delivered products and their online images may exist, but such differences will not engage contractual liability if they do not concern the product’s essential characteristics and do not affect its quality or usability.

Due to various internet browsers and/or monitor settings, the color representation on the Site is indicative and cannot be guaranteed as true to the actual product colors.

All texts, images, photos, trademarks, and logos presented on the BELULL website are globally protected under copyright and intellectual property laws. Their reproduction, even partially, is strictly prohibited.


Article 3 – Validity of Sales Offers

Products are offered for sale until stocks are exhausted. In the event of an order for an unavailable product, the Customer will be informed of its unavailability as soon as possible, by email or postal mail.


Article 4 – Product Pricing

The various sections of our Site indicate prices in euros. Prices are inclusive of all taxes (TTC), including VAT at the applicable rate on the order date, excluding shipping fees.

The VAT amount is specified when the Customer selects a product, and shipping, assembly, or other ancillary service fees appear at the end of the product selection process.

Specific taxes, such as the furniture eco-tax, are only displayed on the shopping cart page, which serves as the definitive reference in case of disputes.

Epsilon Composite reserves the right to modify prices at any time before final order validation, particularly in the event of increased costs, VAT rate changes, or manifest errors. Products are billed at the rate in effect on the Site at the time the order is definitively validated by the Customer.

Products remain the property of Epsilon Composite until full payment is received. However, the risk of loss or damage is transferred to the Customer once they take physical possession of the products.


Article 5 – Order Procedure and Terms

5.1 Customer Identification

To place an order, the Customer must log in to the Site. The Company endeavors to provide permanent access to the Site; however, service interruptions due to technical failures or maintenance may occur without the Company being held liable.

For a first order, the Customer must create an account via the “MY ACCOUNT” section by selecting “New Registration” and providing the required information. The Customer certifies the authenticity and accuracy of this information.

Registration is effective once the Customer clicks “Register.” For subsequent orders, the Customer can access their account using their login credentials. The Customer agrees to use their account strictly for personal purposes and not to share their login details with third parties.

5.2 Placing an Order

The Customer must follow the steps specified on the Site. All orders will be confirmed via an email sent by Epsilon Composite, summarizing the order, delivery address, and payment method. This information is also available in the “MY ACCOUNT” section of the Site.

Before finalizing their order, the Customer may modify it if errors are detected in the entered data. The Customer can only validate their order after reviewing and accepting these GTC by ticking the appropriate checkbox.

An order validated by the Customer is considered effective by Epsilon Composite only after payment confirmation.

5.3 Order Tracking

Once the Customer receives the confirmation email, they can track the status of their order and delivery in the “MY ACCOUNT” section under “MY ORDERS.”


Article 6 – Payment

6.1 Payment Methods

Products are payable in full at the time of order. The following payment methods are accepted:

  • Bank cards: Visa, Mastercard, Amex, and Carte Bleue.
  • Bank transfer: Payment details are provided after order validation.

Epsilon Composite ensures secure online payment via SSL encryption through its payment service provider, PAY PLUG. Card details are not stored by Epsilon Composite.

6.2 Fraud Prevention

To prevent fraud, Epsilon Composite reserves the right to request proof of identity, address, and payment method from the Customer before processing the order. Failure to provide these documents may result in order cancellation.


Article 7 – Delivery

Delivery Times

Delivery times will not exceed four (4) months from the date of payment validation unless force majeure is involved. For in-stock items, delivery times begin upon order registration.

Delivery Methods

Delivery is made by courier or parcel relay, depending on package size and weight. Customers must ensure their premises are accessible for delivery.

Delivery Fees

Delivery fees depend on package weight, delivery region, and accessibility. Additional fees may apply for inaccurate declarations or missed delivery appointments.


Article 8 – Right of Withdrawal

8.1 Conditions for Exercising the Right of Withdrawal

The Customer has 14 calendar days from the day after receipt of the order to exercise their right of withdrawal without providing a reason.

8.2 Return Conditions

Returned products must be in their original condition and packaging, including all accessories. Customers bear the return shipping costs.

Refunds

Refunds will be issued within 14 days of notification of withdrawal, provided the products are returned in the required condition. Refunds are credited back to the original payment method unless otherwise agreed.

Article 9 – Warranties, After-Sales Service, and Spare Parts

9.1 Warranties

All products from Epsilon Composite benefit from the legal warranty of conformity as defined by the French Consumer Code (Articles L. 217-4 to L. 217-14) and the legal warranty against latent defects as defined by the Civil Code (Articles 1641 to 1648).

Exclusions from Warranty

For display models, the Customer expressly agrees to accept the product “as is,” including any visible defects. Consequently, the Customer cannot seek a refund or replacement for the product based on warranty claims related to these defects.

The warranties do not apply in cases of:

  • Normal wear and tear or aging of the products.
  • Use of abrasive or unsuitable cleaning products.
  • Failure to follow usage, assembly, care, storage, or maintenance instructions.
  • Discoloration caused by light exposure, particularly on fabric items, unless the product is described as “UV-resistant.”
  • Shocks or falls of any kind.
  • Force majeure events, such as lightning, floods, fires, or storms.
  • Unauthorized repairs or modifications.
  • The use of non-compliant parts not recommended by Epsilon Composite.
  • Alteration of the product’s structure or materials.

The warranty applies only to repairs, replacements, or refunds of the product and does not cover indirect damages.

Applicable Legal Provisions

Customers are informed of the following legal provisions:

  • Article L. 217-4 of the Consumer Code:
    “The seller delivers a good in conformity with the contract and is liable for defects existing at the time of delivery. This includes defects resulting from packaging, assembly instructions, or installation if these were under the seller’s responsibility.”

  • Article L. 217-5 of the Consumer Code:
    “The good is in conformity with the contract if it:

    1. Is suitable for the intended use and matches the description or sample provided.
    2. Has the qualities reasonably expected based on public statements, advertising, or labeling.
    3. Possesses agreed-upon characteristics or suits any specific purpose made known to the seller.”
  • Article L. 217-9 of the Consumer Code:
    “In the event of non-conformity, the buyer may choose between repair or replacement unless the selected remedy incurs disproportionate costs for the seller.”

  • Article L. 217-12 of the Consumer Code:
    “Actions for non-conformity must be brought within two years of delivery.”

  • Article 1641 of the Civil Code:
    “The seller is liable for hidden defects that render the product unfit for its intended use or significantly diminish its value.”

9.2 After-Sales Service (SAV)

Beyond the legal and commercial warranties, Customers may contact the sales team for inquiries about product use, care, or defective parts by email at contact@belull.com.


Article 10 – Disputes and Liability

The Customer must ensure the accuracy of the information provided during registration and ordering, especially the delivery address. The Company cannot be held liable for delivery errors resulting from incorrect information provided by the Customer.

The Customer assumes full responsibility for the selection and use of products. Incompatibility with other products does not entitle the Customer to compensation or refunds unless due to proven defects or non-conformity.

Epsilon Composite is responsible only for ensuring reasonable means for order processing, delivery, and after-sales service. It cannot be held liable for internet-related issues such as service interruptions, security breaches, or force majeure events.

The products are intended for private use only and are not suitable for professional or collective use unless explicitly specified.


Article 11 – Proof

The computerized records maintained by the Company serve as evidence of communications, orders, and payments between the parties. These records are admissible in court.


Article 12 – Storage and Archiving of Transactions

Order forms and invoices are stored on reliable and durable media to ensure faithful and long-term reproduction in accordance with Article 1348 of the Civil Code.


Article 13 – Force Majeure

Neither party shall be held liable for non-performance or delays resulting from force majeure, as defined in Article 1218 of the Civil Code. The Company disclaims liability for delays or defects in delivery caused by health crises, pandemics, or states of emergency.


Article 14 – Personal Data

Data Collection and Use

By registering on the Site or making purchases, the Customer consents to the collection and use of their personal data by the Company. Personal data may be used for:

  1. Managing and processing orders.
  2. Responding to inquiries via the contact form.
  3. Maintaining a customer and prospect database.
  4. Sending newsletters and promotional offers.
  5. Statistical analysis of site traffic and sales.

Rights and Access

In compliance with the French Data Protection Act (Law No. 78-17), the Customer has the right to access, correct, object to, or delete their data.

Article 15 – Cookies

Cookies may be installed during the Customer’s visit to the Site to track browsing information, such as pages viewed or visit times. The installation of certain cookies does not require prior consent if they are strictly necessary for the provision of requested services or to facilitate electronic communication.

Cookies used for audience measurement or navigation issue detection are retained for a maximum of 25 months, as per CNIL recommendations.


Article 16 – Applicable Law, Mediation, and Dispute Resolution

These GTC are governed by French law.

Before initiating legal proceedings, parties agree to seek an amicable resolution. If no agreement is reached, disputes will be submitted to an appropriate mediator designated by the French Federation of Mediation Centers (FFC Mediation, 2 Place Dauphine, 75001 Paris).

Unresolved disputes will be brought before the competent French courts.


Article 17 – Entire Agreement

These GTC and the order summary form the complete contractual agreement between the parties.
